This agreement will also assist the process in which Home Sorted! Franchise Pty Ltd undertake when deciding your suitability in appointing you as a franchisee. By signing below you are agreeing to the following terms: You understand that our Information Kits, Application Forms, Disclosure Documents, Franchise Agreements, and any and all other materials containing information regarding a Home Sorted! Franchise is confidential and must not be shared with anyone who is unauthorised by Home Sorted! Franchise Pty Ltd. You understand that our Information Kits, Application Forms, Disclosure Documents, Franchise Agreements, and any and all other materials containing information regarding a Home Sorted! Franchise can only be shared with your professional advisors to help you to assess whether or not you want to proceed with the purchase of a Home Sorted! franchise. You understand that you must not distribute our Information Kits, Application Forms, Disclosure Documents, Franchise Agreements, and any and all other materials containing information regarding a Home Sorted! Franchise to any other third party, not involved in the decision making process. You are not connected in any manner whatsoever with any business or service similar to a Home Sorted! Franchise, nor have you been requested to obtain Information Kits, Application Forms, Disclosure Documents, Franchise Agreements, and any and all other materials containing information regarding Home Sorted! Franchise by any other company or individual. If you decide not to proceed you and any advisors/agents must cease to use and retain all Home Sorted! Franchise Confidential Information held by you or within your control. You agree to return that Confidential Information to Home Sorted! Franchise Pty Ltd. You must not then directly or indirectly, as agent, employee or otherwise use or divulge any Confidential Information provided by Home Sorted! Franchise Pty Ltd, except as permitted by Home Sorted Franchise Pty Ltd. In this agreement: Approved Purposes means purposes directly related to the conduct of the Assessment or such other purposes as may be agreed between Home Sorted! Franchise Pty Ltd and you in writing. Confidential Information means: information of a confidential nature concerning or in any way related to Home Sorted! Franchise Pty Ltd.’s business, or that of any of its related corporations, or any of their directors or shareholders except that referred to in (c) below; all manuals, documents, letters, memoranda, computer files or other form of documentation or communication in whatever form of reproduction which evidences, contains or reproduces any of the information; any other agreement or other documents provided Home Sorted! Franchise Pty Ltd or its related corporations except: (i) any information which is in the public domain at the time of provision or which subsequently becomes in the public domain through no breach of this agreement; (ii) is required to be disclosed by law; or (ii) Home Sorted! Franchise Pty Ltd agrees in writing with you that may be disclosed.
